contract, if you decide to purchase with us, you need to send a copy of the
contract along with deposit or full payment, you must agree to terms and sign
on the last page, you will receive a copy at the time you get your new puppy.
If you fail to send us a signed copy when you purchase, we assume you agree to
terms of the contract and you will be provided a copy as a bill of sale for
your record.
I can refuse a sale if I
determine you are not a suitable home for one of our babies. NO PUPPY MILLS,
LARGE KENNELS, PUPPY BROKERS, or PET STORES need to contact us regarding our
babies.
From AKC rules, all AKC
puppies, or offspring of AKC dogs, must be provided a bill of sale on such
puppies.

The price of this puppy

before __________. Buyer(s) is/are aware that the puppy is sold with no
warranties, either expressed or implied, in an AS IS condition with no
guaranties other than those stated herein. DEPOSITS ARE NON-REFUNDABLE. No
refunds. Iskato's Pomeranians does hereby certify
that to the best of our knowledge, the puppy sold is in good health, and that
all shots/wormings are up to date.
DEPOSITS ARE
NON-REFUNDABLE and NON-TRANSFERABLE. If you are unable to finish paying off
your puppy/dog, you will not be refunded the required Deposit for holding, And
possibly any other expenses, such as Shipping Required Health Certificate and
the vet check if the Seller has already Acquired
health certificate for shipping purposes. (any other monies left over will be
refunded by US Money Order if you are unable to purchase and pay final
balance/and shipping is required.. Shipping is normally done on weekends, and
you must set time aside to pick up/sometimes drive to a nearby International
Airport to pick up your new puppy. We will work with you on shipping times, but
this is all out of our hands as we go by what the airlines has available, and
the times cargo offices are open and their requirements on time drop offs. We
try to get your pup to you early as possible in the daytime, but this is not a
guarantee due to airlines flights available, connection flights and layovers.
Puppy(ies) must be completely paid for by the age of 10
weeks, including shipping charges before a puppy is to be shipped. If you
cannot make final payment before 12 weeks of age, you will be responsible for
additional shots/wormings/food of your puppy, and if
not paid for by 14 weeks of age, you forfeit your deposit and the puppy is
available again for sale.
The Buyer is responsible
for promptly notifying the Seller of the puppy/dog safe arrival, either by
email/phone the day of shipping. This does not mean a day or two later, means
the day of shipping.
Purchaser agrees to use
our kennel name "Iskato's" at the beginning
of the registered name of the puppy. NO exceptions.
Pom puppies go through a
change around 12-16 weeks of age, called the puppy uglies
(blowing coat stage), if you receive your puppy during this phase, as the
Buyer, you understand this is a normal stage that ALL poms
go through and is not permanent. Their coats do come back, and this is not an
indication of their quality of coat or that they have a skin disorder. It's
just a normal phase. This is not a legit excuse to return a puppy claiming it
is not a Pomeranian. They all go through this phase. If you have a tiny pup
that has to be kept longer than 10 to 12 weeks, also keep in mind, by the time
this pup is ready for his/her new home, he/she could be at that stage. Do not
be alarmed, it is normal for all Pomeranian puppies to go through this stage.
Puppy(ies) is sold as follow:

as companion/pet with Full AKC papers. There is no guarantee to the breeding quality,
the pup/dog’s breeding capability, size, csections,
interest in breeding etc.

companion/pet with limited AKC registration, sold with the conditions of
spay/neuter.
Retired Pets for
adoption:
_______Sold without
papers, adoption fee plus additional cost set by Seller (price listed above)
for purchase. Pet will be spayed/neutered with
adoption fee cost, and health guarantee is listed in this contract.
_______Sold without
papers, if adoption fee of spay/neuter/and or teeth cleaning is required, there
is no monies rendered to the Buyer but to the services rendered by a veterinarian
to provide these services for placement with the new owner, therefore, there is
no health guarantee as these pets are not being sold, only adopted.
Limited Guarantee: Puppy/Dogs
sold with Full AKC papers are given the same guarantee as for pet. We do not
guarantee the quality of the dog to be show or breeding quality, to be capable
to sire or have litters, to have the ability to free whelp, the ability to
breed, etc.
To the best of the
seller's knowledge, this puppy is free of disease and heart/lung/kidney defects
as of the date of this sale. Puppies(dogs) that are shipped out of state by air
will have obtained a health certificate, flight insurance, crate and rabies if
over 4 months old, expense payable by the buyer.. The buyer has 48 hours from
the puppy's time of arrival to have the puppy checked by a veterinarian of
his/her choice at the buyer's expense. If the buyer's vet exam reveals that the
puppy(dog) has a life threatening disease to the
heart/kidney or the lungs AND a second veterinarian (unassociated with the
first vet) concurs with the diagnosis, the puppy must be returned at the
BUYER'S EXPENSE and must be returned within 72 hours of diagnosis, with
supported vet documentation, and my vet has to agree with the diagnosis, and a
replacement will be made when one becomes available. If you choose not to get a
second vet opinion, you forfeit all guarantees of this contract. If you chose
not to take your new puppy(dog) to the vet within 48
hours, your guarantee is void. If buyer decides not to return a puppy that is
covered under the guarantee, and decides to have the puppy/dog treated by their
vet, then the Seller will no longer be responsible for replacement, and the
Seller is not responsible for any Veterinarian charges.
What is not covered:
We do not guarantee
color, size, quality …we do our best to provide an estimate of size and color.
Guarantee does not cover
ear sets, tail sets, patellas, open fonts/soft spots,
hernias, teeth placement, breeding quality or the capability to breed,
parasites, etc. all are treatable by a veterinarian. We do not guarantee
personalities. All of our babies are socialized before they leave our home.
Please allow time for your new puppy to adjust to his/her new surroundings. We
only replace a puppy due to the listed guarantee, life threatening disease to
the heart/lungs/kidneys.
Toy breeds are
predisposed to losing their permanent teeth, even with routine dentals. Older
toy breeds might be missing a good many of their teeth.
We do our best to have
your new puppy started on potty training, crate training and wee wee pads. It’s the new owner’s responsibility to continue
with the training. We do not guarantee your baby will be house trained or
completely house trained. We do not guarantee that your new puppy will not bark
or chew on house hold items. We recommend training for your new puppy if he/she
develops habits that are not desired.
All pups are sold with
updated shots and wormings. Additional shots/wormings will be the responsibility of the new owner. If
you are purchasing an teenager or an adult, your new
baby will have been started on heartworm prevention, and it will be the new
owners responsibility to continue that treatment prevention.
We do not guarantee
against coccidia/giardia/other
parasites, internally or externally, but we do treat prior to placement, and
cleared though fecal exam. We treat all pups with albon
and flagyl prior to their placement in a new home. We
do our best for prevention, but additional wormings
or albon/flagyl may be
needed. Shipping, new environment, shots/wormings,
new noise/ new food, too much playtime, can all be a stressful factor for your
new puppy…which can lead to hypoglycemic spells, or onset of coccidia/giardia that may be
dormant.
There is no guarantee
against accidents or sickness that was not contracted on the seller's premises.
THE SELLER WILL NOT BE RESPONSIBLE FOR ANY VET BILLS. Any pup returned under
the above warranty guarantee (Heart/lungs/liver) must be returned in the
condition in which received within 72 hours from the time the puppy/dog arrived
to the new owner. If not, the contract is void. If the Seller has agreed to a
replacement, and the buyer decides not return the puppy/dog, the warranty
becomes void, and no replacement will be offered.
Hypoglycemia (low blood
sugar) is a condition, not a disease… It is brought on by not eating properly,
stress, too much handling, shipping, etc. If the puppy is not eating, tempt
him/her with baby food (strained meat), cottage cheese, hamburger or canned
food. Karo syrup can be added to the food or nutra-cal can be given 2 or 3 times a day until he/she is
eating properly. If your puppy is not eating at all, consult your vet.
Force-feeding science diet A/D is recommended. Your puppy has to have food to
survive. The new owner understands he/she is responsible for any additional wormings, heartworm preventions, any additional shots
needed, and any additional care for their new puppy. The Buyer understands that
they are purchasing a puppy that will require vet maintenance and care for the
rest of his/her life. By purchasing you understand this is the responsibility
of the Buyer. Refusal to do these things is considered neglect and makes this
contract null and void. I have the right to request the puppy back if
neglected, or pursue legal action against the buyer.
The buyer understands
that he/she is not to place their new puppy in a rescue organization, a pound,
resell to a pet store or a broker, or to a puppy mill. The buyer understands by
purchasing a puppy from us, that they must offer first refusal rights back to
the seller. If the puppy is not purchased at a price of 25% off the purchase
price by the breeder(Seller), that the Seller will be
allow to help in placement of the puppy. At no time is the Seller under
contract to purchase any puppies back, but that the offer is extended in case
the Seller wishes to purchase the puppy back. The Seller must be notified if
the new owner can no longer keep the puppy, this must happen prior to
placement, not after the fact. I will offer my abilities to help place a puppy
purchased from us if a new owner determines from unforeseen problems that they
no longer can be in ownership of a puppy purchased from us.

I recommend a good high
quality food for your puppy. You will be given a sample food of what your new
puppy is eating. Do not change your puppy’s food immediately, this should be
done gradually. Quick changes in diet can make their tummies upset, loosen
their stool, and a new puppy can refuse to eat at all, causing more serious
problems. Gradually change the diet day to day, until he/she has adjusted to
the new food.
Shipping is available at the Buyer's expense only. Seller is not responsible
for any shipping expenses…and there are no refunds due to shipping problems.
Buyer will receive puppy/adult when weather permits to ship, and will be
arranged by the Seller. ALL SHIPPING CHARGES ARE PAID BY THE BUYER, EVEN IF THE
DOG IS RETURNED TO THE SELLER FOR REPLACEMENT. Out of Country Shipping has additional fees than normal shipping within the U.S.
SHIPPING NOTICE: ALL
Dogs purchased from Iskato's Poms
are required to have shipping insurance. This is purchased at the time of
shipping. After the puppy is released to the airlines, the insurance covers
that puppy for the flight, from loss or injury. When picking up your puppy from
the airport, INSPECT your new puppy to be sure he is okay and in good health
from the flight, inspect before you sign the release that you have received
your puppy in good health, accidents rarely happen, but they can happen,
inspect properly, then sign the release. This releases the airlines from any
additional claims and responsibility. The puppy is your responsibility once you
sign the release, which includes vet care, maintenance, etc. The breeder is not
responsible for accidents or injury due to shipping.
It is the responsibility
of the new owner to have your new puppy a vet appointment prior to arrival for
his/her wellness checkup. We try to keep to the shipping schedule first set up,
but other factors as cancelled flights or bad weather can change the original
flight information for the shipping of your puppy.
All puppies are sold
with AKC papers, whether on limited or full registration, unless noted pet only
without papers. Papers will be sent at the time of puppy pick up or shipping
(or mailed the following week), unless they are not available from AKC at the
time and will be mailed out to the new owner when received from AKC.
As the buyer, you
understand, if purchased puppy is not old enough, big enough, or not quite
ready for shipping, that the Seller, will ship said puppy, when the Seller
feels the puppy will be safe to ship. All puppies are different in maturity,
size, eating habits, and ability to cope with stress, so the Seller must make
judgment on when it is safe for said puppy to be shipped, or we can meet you at
our local airport if flying in to pick up your new baby.
Local pick up is
welcomed BY APPOINTMENT ONLY. If you miss your appt time, you must notify me by
phone and reschedule. I will not tolerate kennel hopping (going from one kennel
to the next), as you are subject to bring disease or germs from one place to
another on your shoes and clothing. These are my pets first and my babies’
health and well being come first. Parents are viewable via my website. When
bringing small children, do not allow your children to pick up any puppies, as
this is how accidents happen, and you will be liable for any injury to any puppy(ies) if this should happen.
The SELLER will not make
any shipping arrangements and will not acquire health certificate required to
ship until puppy is PAID IN FULL. Too many wait till the last day and/or do not
pay till after shipping date, therefore, do not ask for me to make arrangements
till you have paid in full. Adults should be paid in full, and if a deposit is
taken to hold, the hold time will be for 2 weeks period, balance must be paid
in full at that time. The Seller will notify the Buyer by Phone/Email of the
shipping arrangements. I do my best to accommodate buyer’s schedules for
shipping, but due to work schedule/family/etc, I prefer shipping on weekends,
and will make those arrangements to accommodate both seller/buyer.
Health certificates are
only good for 10 days with the airlines. If it expires at no fault of the
Seller, the Buyer will be responsible for the cost of a new health certificate.
If Buyer does not comply
with the above listed details of agreement, this guarantee is null and void.
***NOTE TO BUYER***
Jurisdiction, Venue and Attorney's fees. The sole jurisdiction and venue for
any suit
filed by the Seller or Buyer in any way connected with this agreement shall be
in Hinds County, Jackson, Mississippi. The prevailing party in any litigation
shall be entitled to their reasonable costs and attorney's fees.
At Iskato’s
Poms & Yorkies we want
your experience with a new baby to be a good one, so please educate yourself on
how to care for you new baby, please be prepared prior to your new baby’s
arrival, food, home crate, bedding, toys, nutrical,
etc.
By signing below, you
have read over the bill of sale contract/guarantee and the questionnaire link,
and you fully understand and agree to the terms of purchase contract. If you do
not send in a contract with your deposit/payment, you will forfit
any warranties/guarantees. No one but the SELLER can alter this contract and
provide details with in, if altered by another
individual other than the SELLER, the contract is void and there will be no
guarantee from the SELLER.
Special note for out of
country shipping: All expenses required to ship to your country is the Buyers
responsibility, additional shots, wormings, flea/tick
applications, microchipping, certified pedigrees,
shipping cost, international health certificate and USDA approval, etc.
If any shipping requires
me to travel to another airport than my local internation
airport (JAN) a gas fee charge is required.
