Please read over my contract, if you decide to purchase with us, you need to send a copy of the contract along with deposit or full payment, you must agree to terms and sign on the last page, you will receive a copy at the time you get your new puppy.

No puppy will be shipped or picked up without a signed contract. I can refuse a sale if I determine you are not a suitable home for one of our babies. NO PUPPY MILLS, LARGE KENNELS, PUPPY BROKERS, or PET STORES need to contact us regarding our babies.

From AKC rules, all AKC puppies, or offspring of AKC dogs, must be provided a bill of sale on such puppies.

The price of this puppy is $________(price without shipping). Payment must be received on or before __________. Buyer(s) is/are aware that the puppy is sold with no warranties, either expressed or implied, in an AS IS condition with no guaranties other than those stated herein. DEPOSITS ARE NON-REFUNDABLE. No refunds. Iskato's Pomeranians does hereby certify that to the best of our knowledge, the puppy sold is in good health, and that all shots are current.
Puppy(ies) must be completely paid for by the age of 10 weeks of age, including shipping charges before a puppy is to be shipped. If you can not make final payment before 12 weeks of age, you will be responsible for additional shots/wormings/food of your puppy, and if not paid for by 16 weeks of age, you forfit your deposit and the puppy is available again for sale.

Seller is not responsible for any problems/illness/death due to shipping. Insurance will be purchased on any dog being shipped. Any kenneling cost due to layovers in flight, etc… will be the responsibility of the Buyer.

Purchaser agrees to use our kennel name "Iskato's" at the beginning of the registered name of the puppy. NO exceptions.

Pom puppies go through a change around 12-16 weeks of age, called the puppy uglies (blowing coat stage), if you receive your puppy during this phase, as the Buyer, you understand this is normal stage that ALL poms go through and is not permanent, their coats do come back, and this is not an indication of their quality of coat or that they have a skin disorder, it's just a normal phase.

______ This puppy is being sold as a BREEDING PROSPECT. Seller assumes no responsibility as to the reproduction capabilities of this male or female puppy. Males will have two testicles descended into the scrotum at maturity or a replacement will occur when one becomes available. Seller does not guarantee size as an adult, only size of puppy at the time of sell, and can only guarantee color at time of sale. REPLACEMENT IS THE ONLY OPTION. NO REFUNDS and replacement has to be of equal value. BUYER MUST RETURN DOG AT BUYER's EXPENSE.

_____ This puppy is being sold as a SHOW PROSPECT. This puppy has no major or disqualifying faults for his/her age AS OF THE DATE OF THIS SALE. (A definitive evaluation cannot be made on puppies under 6 months of age.) REPLACEMENT IS THE ONLY OPTION. Show Prospect means at the puppy's age, he/she is a show potential, no guarantees are made on puppies under 6 months of age.

To the best of the seller's knowledge, this puppy is free of disease and heart/lung/kidney defects as of the date of this sale. Puppies that are shipped out of state by air will have obtained a health certificate, flight insurance,crate and rabies if over 4 months old, expense payable by the buyer.. The buyer has 36 hours from the puppy's time of arrival to have the puppy checked by a veterinarian of his/her choice at the buyer's expense. If the buyer's vet exam reveals that the puppy has a life threatening disease to the heart/kidney or the lungs AND a second veterinarian(unassociated with the first vet) concurs with the diagnosis, the puppy must be returned at the BUYER'S EXPENSE and must be returned within 48 hours of diagnosis, to the seller, and a replacement will be made when one becomes available. If you chose not to get a second vet opinion, you forfit all guarantees of this contract. I do not guarantee Patellas, coats, color, size, earsets, tailsets, personality. I do not guarantee against Cocsidia (but I do give albon/flagyl for prevention before pup leaves), I deworm before puppy leaves my home and have a fecal exam done by my vet, but your puppy may need additional wormings upon arrival if your pup sheds more parasites after a negative fecal results. The seller will only consider replacement due to mentioned above health issues, not because the Buyer changes his/her mind, puppy/dog barks, puppy/dog chews, house breaking issues, or for any other reasons, etc. All of these issues can be addressed with proper training by the new owner. Intent to return the puppy for replacement must be made within 24 hours of the buyer's vet exam and REPLACEMENT IS THE ONLY OPTION. There is no guarantee against accidents or sickness that was not contracted on the seller's premises. THE SELLER DOES NOT AND WILL NOT BE RESPONSIBLE FOR ANY VET BILLS after the puppy is picked up or shipped to the new owner. Buyer shall have no right to demand a refund of purchase price and hereby agrees to accept replacement of a puppy affected with the mentioned guarantee (heart, lungs, liver). If the puppy dies within 48 hours of the time of purchase, buyer must have an autopsy performed at Brookhaven Animal Hospital, or Forest Hill Animal Hospital, at the buyer's expense in order to determine cause of death. Puppy will be replaced only if the death was a result of an illness that was contracted prior to the time of sale, provided that no signs of abuse or neglect are found. This guarantee does not cover accidents, neglect or Hypoglycemia (low blood sugar) as this is a condition not a disease… It is brought on by not eating properly, stress, too much handling, shipping, etc. If the puppy is not eating, tempt him/her with baby food(strained meat), cottage cheese, hamburger or canned food. Karo syrup can be added to the food, or nutra-cal can be given 2 or 3 times a day until he/she is eating properly. If you puppy is not eating at all, consult your vet, force feeding science diet A/D is recommended, your puppy has to have food to survive. Puppies are vet checked for being healthy before they leave the Seller, The new owner understands that at that point, the buyer is responsible for any additional wormings, heartworm preventions, any additional shots needed, and any additional care for their new puppy. The Buyer understands that they are purchasing a puppy that will require vet maintenance and care for the rest of his/her life, by purchasing you understand this is the responsibility of the Buyer, refusal to do these things is consider neglect and makes this contract null and void.

Puppies that are picked up and transported on a long trip to their new home, should be provided care/food/water and comfort for this trip by the BUYER. The Buyer is the only person that will be allowed to pick up the puppy, no second hand delivery. I will not be held responsible for accidents once a puppy is picked up, be sure your puppy is secured in a carrier and not sitting in a car seat or someone's lap. Puppies can be injured this way. Also be careful when letting your new puppy out to potty, only allow in secure areas, as puppies can be frightened by loud noises and dash out or run into traffic. Young children and tiny toy breeds are not a good mix, if you allow young children to be around you new puppy, SUPERVISION is highly recommended, as accidents can happen and can cause injury or death.

Until your new puppies has had all of it's puppy shots, the Buyer agrees to not expose the puppy to other puppies/dogs of unknown vaccinations records, no trips to Petsmart or doggy parks, puppies can still catch diseases until they are fully vaccinated.

All pups are treated with albon/flagyl prior to going to their new home for precaution. Shipping and new home environment can bring on stress, therefore, puppy might need additional treatment if signs of Coccidia/giardia are present at the buyer's wellness vet exam. Sometimes puppies will not want to eat after shipping, be sure your puppy eats, if after a couple of days, your puppy is not adjusting and eating well, contact your vet immediately.. If you fail to take your new puppy to the vet within 36 hours after arrival, this contract is null and void on any types of warranties, and the Seller is not liable for any guarantee previously offered. This guarantee does not cover treatable things such as fleas/ticks, parasites, earmites, cocsidia, giardia, etc. All these things can be treated by a license vet, as they are treated prior to leaving the sellers premises, but additional treatments may be needed. Your puppy will have a regular vet check before he/she leaves to insure a healthy puppy which includes a fecal.

It is your responsibility to maintain any vet check ups once your new puppy arrives, keep shots up to date and wormings up to date, provide heartworm prevention monthly, and maintain a proper diet for you new baby.

***NOTE TO BUYER***
Jurisdiction, Venue and Attornye's fees. The sole jurisdiction and venue for any suit
filed by the Seller or Buyer in any way connected with this agreement shall be in Hinds County, Jackson, Mississippi. The prevailing party in any litigation shall be entitled to their reasonable costs and attorney's fees.
The Buyer also agrees that said puppy is not being purchased for any other person other than who is listed on this contract. This puppy is not being purchased to be resold to another individual(s), breeder, Pet Store, etc.
If this puppy is being sold as a pet only without breeding rights, the said puppy must be 'fixed' and must not be used for breeding, meaning also, this puppy is not to be register 'CKC' and used for breeding.
I recommend a proper diet with Pro Plan, Iams Products, or Science Diet, Bil-Jac Select, no table scraps, to maintain a fit, trim and healthy pomeranian. If you switch your puppies food from what he/she is eating, do it gradually, switching food gradually will avoid any food refusal, upset stomach or loose stool. Quick food change will only make your puppies stomach upset and your pup could get sick and stop eating.

Seller retains first refusal right to purchase a puppy back at a reduced price of 25% off of the purchase price(not including shipping or vet bills). I must be notified of your decision to no longer keep your puppy. If the Seller does not buy the puppy back, the Buyer can place the puppy up for sale (with terms to an approved pet home), and not for more than the original purchase price. If the new owner, needs help placing the puppy for sale, the breeder will help find a new home for a puppy. There are times when a person buys a puppy on impulse and decides that no longer want to be a pet owner, or they purchased a puppy without consulting their spouse, and now they are not able to keep the puppy. I ask that you consider the responsibilities that you will have as a new pet owner, vet bills, care and maintenance, training, etc, Discuss with your spouse/family before you purchase a new puppy. I can not purchase a puppy back for these reasons and/or other reasons other than stated above due to health guarantee, but will help you place your new puppy for you. We do hope that all new owners have done their research for preparing for their new puppy and the responsibility they will now have. Please review what I guarantee, as a breeder, we don't guarantee size, color, temperment, patellas, etc. We also ask that if you live in an apartment, check your rental policy for pets, we will not buy back a puppy if you can't not have pets in your apartment/condo. Also in some counties/state, there is a pet limit, please know those laws, as we can not purchase back a puppy because of a limit law. We will be more than happy to help you find a new home for your puppy, but we are not able to purchase back for these reasons.

Shipping is available at the Buyer's expense only. Seller is not responsible for any shipping expenses…and there are no refunds due to shipping problems. Buyer will receive puppy/adult when weather permits to ship, and will be arranged by the Seller. ALL SHIPPING CHARGES ARE PAID BY THE BUYER, EVEN IF THE DOG IS RETURNED TO THE SELLER FOR ANY REASON. Local pick up is also welcome.

SHIPPING NOTICE: ALL Dogs purchased from Iskato's Poms are required to have shipping insurance, this is purchased at the time of shipping. After the puppy is released to the airlines, the insurance covers that puppy for the flight, from lose or injury. When picking up your puppy from the airport, INSPECT your new puppy to be sure he is okay and in good health. Then at that time you can sign a release to the airlines, which states you have received the puppy in good health, this releases the airlines from any additional claims and responsibility. Don't sign a release until you have inspected your new baby. Accidents rarely do happen, but can happen, that is why I require insurance on all puppies sold. The puppy is your responsiblity once you sign the release, vet care, maintenance, etc. The breeder is not responsible for accidents or injury due to shipping.

THIS MEANS, YOU CAN NOT RESELL THIS PUPPY WITHOUT THE KNOWLEDGE OF THE SELLER/BREEDER!!!!! BY BUYING FROM ISKATO'S POMS & YORKIES, YOU ARE AGREEING THAT YOU ARE NOT BUYING THIS PUPPY FOR RESALE, YOU ARE NOT A PET STORE, YOU ARE NOT A PUPPY BROKER, YOU ARE NOT BUYING THIS PUPPY FOR ANOTHER PERSON, SUCH AS A BREEDER. YOU ARE BUYING THIS PUPPY FOR THE PERSON LISTED ON THE ABOVE CONTRACT.

It is the responsibility of the new owner to have your new puppy a vet appointment prior to arrival for his/her wellness checkup. Responsibilities also include additional wormings, vaccinations, heartworm prevention, to be maintained by the new owner. Please shop around for a reliable small breeds vet, one you can rely on after hours, if you should need service.

All puppies sold with AKC papers, whether on limited or full registration, unless noted pet only without papers. Papers will be sent at the time of puppy pick up or shipping, unless they are not available from AKC at the time and will be mailed out to the new owner when received from AKC.

As the buyer, you understand, if purchased puppy is not old enough, big enough, or not quiet ready for shipping, that the Seller, will ship said puppy, when the Seller feels the puppy will be safe to ship. All puppies are different in maturity, size, eating habits, and ability to cope with stress, so the Seller must make judgement on when it is safe for said puppy to be shipped, pick up is welcomed, or we can meet you at our local airport if flying in to pick up your new baby.

The SELLER will not make any shipping arrangements until puppy is PAID IN FULL, and Puppy has received his/her health certificate required to ship. The Seller will notify the Buyer by Phone/Email of the shipping arrangements. I do my best to accommidate buyers schedules for shipping, but due to work schedule/family/etc, I prefer shipping on weekends, and will make those arrangements to accommidate both seller/buyer.

Health certificates are only good for 10 days with the airlines.
